WhatsChat terms of use

These terms cover WhatsChat, a Wix App Market app published by Nightly Solutions. Installing the app means accepting them.

Wix's own Terms of Use apply to your Wix account and to the App Market itself. Where these terms and Wix's conflict about anything Wix provides, Wix's win.

1. What the app does

WhatsChat adds a floating chat button to your Wix site. A visitor taps it and is sent to WhatsApp, Facebook Messenger, Instagram, Telegram, Viber, SMS, a phone call, email, or one of the other channels you configure, usually with a first message already written.

It opens links. It is not a messaging service, does not carry your messages, and has no connection to the WhatsApp Business API or to any platform account of yours.

2. Your account and your site

You need a Wix site and the right to install apps on it. You are responsible for the phone numbers, handles, names, photos and wording you put into the widget, and for having the right to use them.

3. Plans, prices and billing

The app has a free tier and one paid tier, sold three ways: monthly, yearly, and a single Lifetime payment. Current prices are on the App Market listing.

Wix handles every payment. We never see a card. Billing, invoices, renewals, refunds and cancellation all run through your Wix account, under Wix's terms.

Lifetime means the lifetime of the app: as long as WhatsChat is published and maintained, a Lifetime purchase keeps every paid feature, with no renewal and no further charge. If we ever discontinue the app, section 9 says what happens.

The launch promise. Every paid feature is free for everyone until 1 November 2026. Any site with WhatsChat installed before that date keeps full access permanently, at no cost, with nothing to claim and nothing to renew. This is implemented in the app itself, not administered by hand, so it cannot quietly lapse.

4. Free tier

The free tier covers one WhatsApp agent on every page, with unlimited visitors, and shows a small "by WhatsChat" badge in the widget. There is no view cap, no message cap, and no expiry. Removing the badge requires a paid plan.

5. Your data

Everything the app stores goes into Wix CMS collections on your own site under your own Wix account: your settings, the click log, and any leads captured by the away-hours form. We hold no copy and have no access to it.

Uninstalling leaves those collections in place, deliberately, so that contact details you collected are not destroyed by an uninstall. Delete them in your site's CMS when you want them gone.

6. What you may not do

  • Use the app to send unsolicited bulk messages, or for anything unlawful.
  • Break the terms of WhatsApp, Meta, Telegram or any other service the widget links to. Those relationships are between you and them.
  • Resell, sublicense or redistribute the app itself. Using it on sites you build for clients is fine and expected; selling it on as your own product is not.
  • Attempt to bypass the plan limits in the app.

7. Third-party services

The widget links to services operated by other companies. Their availability, their rules and their treatment of your messages are theirs, not ours. If WhatsApp changes how its links work, we will follow the change as quickly as we can, but we cannot promise a service we do not run.

Logos of those services appear in the widget to label the link that opens them. They belong to their owners. Their presence does not mean any of them endorses, sponsors or is affiliated with this app.

8. Support

There is no contractual response time. What there is: a small team that reads every message, and a changelog you can check.

9. Availability, changes, and ending

The app is provided as it is. We do not guarantee uninterrupted service; parts of it depend on Wix and on services none of us control.

Features may change. Where a change removes something you were relying on, we will say so in the release notes rather than letting you discover it.

You may uninstall at any time. Cancel the subscription in your Wix account; uninstalling alone does not stop a subscription.

We may suspend an installation that breaches section 6.

If we ever discontinue the app, we will give at least 90 days' notice through the dashboard and by email, and Lifetime purchasers who bought within the preceding 12 months will be refunded pro rata.

10. Liability

To the extent the law allows, Nightly Solutions is not liable for indirect or consequential loss, for lost profit, or for business lost through the widget being unavailable. Our total liability is capped at what you paid us for the app in the 12 months before the claim.

Nothing here limits liability for death, personal injury, or fraud, and nothing here removes rights you have as a consumer that cannot be signed away.

11. Governing law

These terms are governed by the laws of Bangladesh, and its courts have jurisdiction, except where the law of your own country gives you a right to your local courts.

12. Changes to these terms

If these terms change, the updated version appears here with a new date, and a material change is announced in the app dashboard. Continuing to use the app after that means accepting the new version.
